Who may use Vicin
Vicin is offered for business or professional use in the United States. You must be at least 18 years old and legally able to enter a binding agreement. Consumer, household, and personal use is not intended.
Permitted use
You may use Vicin only for lawful business work and only for accounts, locations, websites, and data you are authorized to access. You may not:
- Use Vicin to violate law, privacy rights, intellectual property rights, provider rules, or another person's agreement.
- Access another customer's account or data without permission.
- Introduce malicious code, evade security controls, probe for vulnerabilities without written authorization, or interfere with service operation.
- Use Census Bureau data, alone or with other information, to identify or re-identify any person, household, business, or other entity, or imply Census Bureau endorsement.
- Misrepresent Vicin data as a guarantee, a verified cause, or professional legal, financial, or accounting advice.
- Copy, resell, reverse engineer, or use Vicin to build a competing service except where applicable law does not allow that restriction.
Connected and third-party services
Vicin may retrieve information from Google and other services only after an authorized connection or where the information is lawfully public. Your use of a connected service remains subject to that provider's terms and settings. Providers may change or end access, alter data, impose quotas, or experience outages. Vicin is not responsible for a third-party service or for data that the provider makes unavailable, inaccurate, delayed, or incomplete. The Privacy Policy and Cookie Policy explain how Vicin handles information, cookies, and similar technologies. A visitor's cookie choice controls optional website analytics and does not change these Terms.
Fees, trials, and cancellation
Prices, usage limits, trial terms, taxes, and cancellation choices will be shown before a paid purchase or stated in a written order form. Those purchase terms become part of this agreement. Paid subscriptions automatically renew each month until canceled. Square charges the payment method associated with the subscription for each monthly renewal. Cancellation stops future renewals and does not erase amounts already due. If you cancel, you will keep access through the end of the monthly billing period you already paid for, and access will end when that period expires. Unless the purchase terms say otherwise, paid charges are non-refundable except where law requires a refund. Vicin may change future prices with the prior notice required by law or the applicable purchase terms.
Customer data and Vicin materials
As between you and Vicin, you retain rights in information you submit or connect. You give Vicin a limited right to host, copy, process, transmit, and display that information only as needed to provide, secure, support, and improve the requested service and to meet legal duties. You are responsible for the accuracy, legality, permissions, and backups of information you provide. Vicin and its licensors retain rights in the service, software, design, methods, documentation, and materials created by Vicin. Feedback may be used without restriction or payment, but Vicin will not identify you publicly as its source without permission.
Suspension and termination
You may stop using Vicin and request account closure. Vicin may limit or suspend access when reasonably needed to address a security threat, suspected fraud, unlawful use, nonpayment, material breach, provider restriction, or risk to other customers. Where practical, Vicin will give notice and a chance to resolve the issue. Vicin may end this agreement for an uncured material breach or if the service is discontinued. Terms that by their nature continue after termination remain in effect, including payment duties, ownership, disclaimers, liability limits, indemnity, and governing law.
Service disclaimers
To the fullest extent allowed by law, Vicin is provided on an as-is and as-available basis. Vicin disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Data, comparisons, forecasts, recommendations, and AI-assisted output may be incomplete, delayed, or wrong and should be checked before a material decision. Vicin does not guarantee rankings, traffic, leads, revenue, or other business results. Vicin does not provide legal, tax, accounting, or financial advice.
Limits on liability
To the fullest extent allowed by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, data, or business interruption, even if advised that such harm was possible. Vicin's total liability arising from or related to the service or these terms will not exceed the fees paid or payable to Vicin for the affected account during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not allow them.
Indemnity
To the extent allowed by law, you will defend and indemnify Vicin from third-party claims, losses, and reasonable costs arising from your customer data, your unlawful or unauthorized use, your breach of these terms, or your violation of another person's rights. Vicin will give prompt notice of a covered claim and reasonable cooperation. You may not settle a claim in a way that admits fault by or imposes an obligation on Vicin without Vicin's written consent.
Governing law and disputes
These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a state or federal court located in Utah, and each party consents to that court's jurisdiction and venue. Before filing a claim, each party agrees to give written notice and allow 30 days for a good-faith attempt to resolve it, except where urgent court relief is reasonably needed.
Changes to these terms
Vicin may update these terms for future use of the service. The effective date will be updated, and material changes will receive notice appropriate to the account and applicable law. Continued use after the updated terms take effect means you accept them. If you do not accept an update, you must stop using Vicin and cancel before it takes effect.
